WILLS AND TRUSTS.

We believe that every client of ours should have made a Will. It is one of the most important things in putting you affairs in order. Without a Will the law will decide what happens to your money and home when you die. And there can be some unpleasant surprises when this happens.

It is essential to consider the effect of Inheritance Tax when making a Will. There are ways in which this tax can be eliminated or reduced. We can assist (if necessary in conjunction with your Financial Adviser or your Accountant) with your tax and estate planning needs.

Our approach is to begin with an exploratory meeting, followed by detailed written advice. We do our best to use plain English in our documents – a simple Will may be only a couple of pages, but the detailed advice can be more than twice that!

LIVING WILLS
These enable you to give directions about medical treatment in the event of a terminal illness. We can advise on a suitable document setting out your wishes and the procedure to be followed

TRUSTS
We can carry out all necessary formalities and drafting of documents to set up family trusts, children's settlements and charitable organisations.

At Jackman Woods we believe that the elderly often need specific legal assistance with their affairs. Our relationship with clients does not come to an end when the Will has been signed and we can help with.


ENDURING POWERS OF ATTORNEY

Appointing someone to help manage finances and deal with property matters

FINANCIAL PLANNING
In association with your financial adviser (or one we recommend) we can assist in raising funds to pay care costs and investing house sale proceeds

ESTATE PLANNING
It may be possible to arrange your affairs so that you do not leave a large Inheritance Tax bill for your family after you die

GENERAL MANAGEMENT
We can arrange for someone to visit you periodically to discuss your finances, care needs and benefits entitlements.

LEGAL ADVICE CLINICS
We can arrange to attend care homes and sheltered housing groups to give free advice interviews and group talks on selected topics.

LIVING WILLS
While not exclusively for elderly clients, these enable you to give directions about medical treatment in the event of a terminal illness. We can advise on a suitable document setting out your wishes and the procedure to be followed

We are always willing to visit our elderly clients at home, if this is more convenient, or if you have a disability.

There is generally no additional charge for this.

We will always allow enough time to take your instructions carefully and fully, without pressure – and we always understand if it takes more than one visit to sort things out.

PROBATE.

When a person dies, their assets must be valued and collected and their liabilities and taxes assessed and paid. The person responsible for this is the Executor appointed by the Will, or the Administrator when there is no Will. It can be a simple matter when there are few assets and no tax to pay. In other cases, it can become extremely involved.

We recognise that this can be a major worry at a sad and stressful time for the family of the deceased and we strive to be sympathetic and understanding: we believe we can often relieve the family of a great deal of worry.

JACKMAN WOODS can offer a number of options;

In simple cases, we can offer a fixed-price administration service
We can arrange to act in obtaining the Grant of Probate and , at that point, hand the file over to the Executor to finish the administration
In higher-value cases, we will conduct the entire matter on behalf of the executor at the estate's expense, including all necessary Taxation issues.
We can, in appropriate cases, even register the death, arrange the funeral and deal with clearance of personal effects.

Charges
We will usually charge on the basis of time spent and will advise you at the outset of the hourly rate and the approximate timescale. We may be able to offer a fixed fee solution. We will never charge more than the rates recommended by the Law Society.
